Agri-Tourism Liability Waiver

Under AL law there is no liability for an injury or death of a participant in a registered agritourism activity conducted at this registered agritourism location if such an injury or death results from the inherent risks of the agritourism activity. Inherent risks of agritourism activities include, among others, risk of injury inherent to the land, equipment, and animals, as well as the potential for you to act in a negligent manner that may contribute to your injury or death. I assume the risks for me, and the children in my care, of participating it the Hubert Farms Corn Maze, a registered agritourism activity.
I hereby release and agree to hold Hubert Farms Corn Maze harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the maze.

I understand that by agreeing to the statements and submitting this form I am indicating that I have read, understand and agree to its terms. I understand that I must read, understand and agree to this Waiver of Liability/Agreement as a condition of being allowed on the premises.I understand that I am financially responsible for any damage caused.

I understand that I will be exposed to risks and hazards while on the premises.

I freely and voluntarily acknowledge these risks and hazards and nonetheless wish to enter onto these premises.

I am aware that walking through the corn maze at night has added risks such as, but not limited to tripping and falling.

I certify that I am in good health and that I do not have any ailment or condition that could worsen, cause injury, illness or death as a result of walking in the corn maze.

I am aware that emergency medical help may not be immediately available due to the location of the corn maze.

As a condition of being allowed on the premises I knowingly and voluntarily waive my legal rights that I may have against the operator of the corn maze, employees and land owners.

I agree to the Safety Rules listed here.

Closed toe shoes are to be worn.
Those 12 years of age and under must be accompanied by a parent or guardian at all times in the maze and on the site.
No alcohol or drugs or smoking or vaping on the premises.
No pets on the premises.
No food or drink with the exclusion of water are allowed in the corn maze.
No picking corn cobs.
No throwing of cobs.
Stay on pathways only. Do not cross Caution Tape.
No cutting through the corn.

Inherent Hazards & risks include, but are not limited to:
Risk of injury from the activity
This activity takes place outdoors, therefore includes risks associated with elements such as excessive heat, hypothermia, encountering objects either natural or man made.
Attack by encounter with insects, reptiles, and/or animals.
Accidents or illnesses occurring in remote places.
Fatigue, Chills, or Dizziness.
*I understand the description of these risks is not complete and that the unknown or the unanticipated risks may result in injury, illness, or death.

Release of Liability, Waiver of Claims, and Indemnity Agreement
In consideration of being permitted to participate in the activities described above, I hereby agree, acknowledge, and appreciate that:
1. I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, the following named person or entities, herein referred to as releases: Hubert Farms, LLC.
2.To release the releasees, their officers, volunteers, staff, owners, vessels and operators from liability and responsibility whatsoever and for any claims or causes of action that I, my estate, heirs, survivors, executors, or assigns may have for personal injury, property damage, or wrongful death arising from the above activities whether caused by active or passive negligence of the releases or otherwise.
3. By entering into this Agreement, I am not relying on any oral or written representation or statements made by the releases, other than what is set forth in this Agreement.
This release shall be binding to the fullest extent permitted by the law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforced.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING IT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
